Terms of use

These terms govern access to Brakan during its current private UK pilot. By using an authorised account, you agree to them. Brakan – Property Keeper is operated by James Ralph Webster as a sole trader and is not presently offered as a general public subscription service.

Authorised use

You may use Brakan only for a portfolio you own, manage or have been authorised to access. Keep credentials secure, use accurate information, assign appropriate team roles and promptly remove access that is no longer required. You must not probe security, bypass access controls, introduce malicious material, misuse personal data or use the service unlawfully.

Your records and responsibilities

You retain responsibility for records you enter and for deciding how they are used. You must have a lawful basis for personal information and documents uploaded to Brakan. Brakan helps organise records; it does not replace professional legal, tax, accounting, safety or property-management advice. You remain responsible for statutory deadlines, notices, calculations and decisions.

Policies that form part of these terms

Your use must comply with the Acceptable Use Policy and Fair Usage Policy. The current Data Processing Terms are a launch draft and become contractually operative only when expressly incorporated into an identified Services Agreement. Bank transaction imports

Brakan currently accepts transaction imports using its published CSV template. Direct bank-export compatibility is not promised. You must import only records you are entitled to process and review transactions before relying on them. Flexible bank CSV parsing, PDF bank-statement parsing, live bank connections and payment initiation are not part of the current service.

Pilot availability

The pilot is supplied without a service-level guarantee and may change, experience faults or be suspended for security, maintenance or legal reasons. Reasonable care is taken to preserve and protect records, but you should retain independent copies of critical documents and information.

Third-party services

Brakan depends on third-party hosting, authentication, email, security and storage services. Their availability is partly outside Brakan's control.

Intellectual property

You retain rights in records and content you provide. You grant Brakan the limited permission needed to host, copy, secure, back up, transform and transmit that content solely to provide and protect the service. Brakan software, branding, documentation and service design remain protected by their applicable rights.

Communications

Service, security, legal and account messages may be sent to the account email or shown in the application. Customers remain responsible for recipient details and the content of communications they authorise Brakan to send on their behalf.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Brakan is not responsible for indirect or consequential loss, loss caused by inaccurate user data, missed professional or statutory action, decisions made from unreviewed bank data, or interruption of a third-party service. These pilot terms do not affect any mandatory consumer rights.

Ending access

You may stop using Brakan at any time. Access may be suspended where necessary to protect users, data or the service, or where these terms are materially breached. Applicable records may be retained after access ends where required for security, legal claims or legal obligations. Changes

Pilot features and these terms may change. Material changes will be dated and communicated before they take effect where reasonably possible. Paid subscriptions will require separate clear commercial terms and acceptance before charging begins.

These terms are governed by the laws of England and Wales, subject to any mandatory rights that apply elsewhere. Questions can be sent to support@mail.brakan.co.uk. The operator's ICO registration is ZA652520, with Brakan - Property Keeper recorded as a trading name.
